Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Nightcase mobile game and related services (the "App"), provided by Flexx Labs ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License to Use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved.

3. Acceptable Use

You agree not to:

• copy, modify, reverse-engineer, decompile, or create derivative works of the App, except where such restriction is prohibited by law;
• access the App through unauthorized means, bots, or automated scripts, or circumvent security or app-integrity measures;
• disrupt, overload, or interfere with the App or its servers;
• use the App for any unlawful purpose or in violation of these Terms;
• resell, sublicense, or commercially exploit the App or its content.

4. Intellectual Property

The App and all of its content — including cases, characters, artwork, text, audio, code, and the "Nightcase" name and branding — are owned by Flexx Labs or its licensors and are protected by intellectual-property laws. All characters, events, and scenarios in the App are entirely fictional; any resemblance to real persons or events is coincidental.

5. Your Account

If the App offers accounts or sign-in, you are responsible for maintaining the security of your account and for activity that occurs under it. Notify us promptly of any unauthorized use. Our handling of account data is described in our Privacy Policy.

6. Purchases and Content

If the App offers any paid content or in-app purchases, such transactions are processed by the applicable app store (for example, the Apple App Store or Google Play) under that store's terms. Except where required by law or the store's policies, purchases are non-refundable. We may add, change, or remove features, cases, or content at any time.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Flexx Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD $10.

9. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Flexx Labs operates, without regard to its conflict-of-laws rules, unless mandatory local law provides otherwise.
